Centrical provides organizations (“Subscribers”) a digital online platform which is intended to drive their personnel motivation and improve their performance through personalized gamification, engagement automation, personalized goals setting, and real time feedback, via a browser, desktop and mobile application (the “App” and together the “Platform”) and other associated products and services.

Biz-Effective Ltd. (“Centrical”, “we” or “us”) respects the privacy of the users of our Platform (as defined below). Users include those users who were designated by our subscribers/customers as authorized administrators or the Subscribers Platform usage (the “Subscribers Admin”) and Subscribers’ end users, namely employees and other personnel of the Subscriber who install and/or use the App (the “End Users“). Users also include visitors of our website located at: www.Centrical.com (a “Visitors” and the “Site”, respectively).

We are committed to protect the personal information of Visitors, Subscribers Admins and End Users (each and together “you” or “User“) which we process in connection with the use of our Site and Platform, as applicable (collectively – the “Services”).

This Privacy Policy (the “Privacy Policy”) is intended to describe our practices regarding the information we may collect from you when you use the Services (or any part thereof), the manners in which we may use such information, and the options and rights available to you.

Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use available at https://www.centrical.com/terms-of-use/ (the “Terms”), which this Privacy Policy is incorporated thereto by reference.

  • Your Consent (PLEASE READ CAREFULLY!)

    BY ACCESSING AND/OR USING THE SERVICE (OR ANY PART THEREOF), YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. BY VISTING THE SITE AND/OR INSTALLING AND IMPLEMENTING OR ACCESSING THE PLATFORM (INCLUDING THROUGH USE OF THE APP), YOU AGREE TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION (AS DEFINED BELOW).   • What Types of Information Do We Collect?
    1. First – What is Personal Information?Personal Information is individually identifiable information, namely information that identifies an individual or may with reasonable efforts or together with additional information we have access to, enable the identification of an individual, or related to an individual or may be of private or sensitive nature information relating to an identified or identifiable natural person. Identification of an individual also includes association of such individual with a persistent identifier such as a name, an identification number, persistent cookie identifier etc.Personal Information does not include information that has been anonymized or aggregated so that it can no longer be used to identify a specific natural person.
    2. Different Data SubjectsAs reflected above we consider three types of Users with respect to whom we process personal information: Visitors, Subscriber Admins, and End Users. These Users types differ in the scope and nature of personal information we may process in relation to them. For example, we process relatively little personal information of Visitors to our Site. On the other hand, since the core of our Services is all about interaction with End Users, this requires us to process a greater amount of personal information in relation to End Users in order to provide our Services to our Subscribers.
    3. Subscriber Admin DataWe collect and process the following categories of personal information related to You if you are a Subscriber Admin:
      1. Actively provided Subscriber Admin’s Data: You actively provide us any actively provided entries, text input, uploaded data or actions in our Platform and App, for example:
        1. Subscriber Admin’s contact information and birthday (without age),
        2. Subscriber Admin’s association/employment with Subscriber, including hiring and termination date (if applicable) at Subscriber,Subscriber Admin’s picture,
        3. Subscriber Admin’s Platform and system preferences
        4. The contents of your interaction with our customer support or sales departments, which may include text/video/audio recording and transcripts of such communications
      2. Subscriber Admins’ system data such as device model/type, web browser version, screen resolution, operating system etc.
      3. Subscriber Admins’ Platform and App session data, such as IP address, Subscriber Admins’ click-stream, preferred language, duration of session, time and date of session, session replay and session heatmaps, etc.
    4. End User Data
      We collect and process the following categories of personal information related to You if you are an End User:

      1. Data we are actively provided with by End Users or by Subscriber Admins, such as any entries, input text, uploaded data, or actions, in our Platform and App, for example:
        1. End User’s contact information and birthday (without age),
        2. End User picture
        3. End User profile preferences (application settings, etc.)
        4. End User association/employment with Subscriber, including hiring and termination date (if applicable) at Subscriber,
        5. End User designation within Subscriber including End User’s subordinates and superiors.
        6. End Users work related completed tasks,
        7. End User work related achievements.
      2. End User’s system data such as device model/type, web browser version, screen resolution, operating system etc.
      3. End User’s Platform and App session data, such as IP address, Subscriber Admins’ click-stream, preferred language, duration of session, time and date of session, session replay and session heatmaps, etc.
      4. Work analysis data concerning End User’s performance and productivity derived from End User’s achievements, completed tasks and work related Platform use data.
      5. Data obtained from End User’s use of the Platform functionality such as member-to-member communications and online chats.
    5. Visitors Data
      We collect and process the following categories of personal information related to You if you are a Visitor of our Site:

      1. Data You actively provide us, such as in an email or the correspondence You may send us to our address as listed on our Site, or any entries and text in our Site forms, for example, to our “contact us” form, or “request a demo” form.
      2. Visitors’ system data such as device model/type, web browser version, screen resolution, operating system etc.
      3. Visitors’ browsing session data such as IP address, information we derive from Visitors’ IP address such as city and country associated with the IP address, Visitors’ click-stream, HTTP referral, preferred language, duration of session, time and date of session, session replay and session heatmaps, etc.
      4. The contents of your interaction with our customer support or sales departments, which may include text/video/audio recording and transcripts of such communications
  • How Do We Collect Personal Information?

    There are three main ways in which we collect Personal Information: (i) information is actively provided to us by the User, (ii) information is collected automatically and is derived by our systems from your use of our Platform, Services and Apps, (iii) information we obtain from other sources or third parties.

    1. Actively provided information. Generally, this category refers to any information, data or content you actively create, input or provide through our Platform, Services or Apps. PLEASE NOTE – IF YOU GIVE US PERSONAL INFORMATION ABOUT SOMEONE ELSE, YOU MUST DO SO ONLY WITH THAT PERSON’S EXPRESS AUTHORIZATION. YOU SHOULD INFORM THEM HOW WE COLLECT, USE, DISCLOSE, AND RETAIN THEIR PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICY BEFORE YOU PROVIDE US WITH THEIR PERSONAL INFORMATION.
    2. Automatically collected information. This category refers to personal information automatically collected from User’s use and interaction with the Platform, Services or Apps. We collect information about your interaction with our Platform and Apps, in certain cases about your impressions of and reactions to our advertisements, and information related to our communications with you. This is information we receive from devices (including mobile devices) and software you use when you access our Platform or Apps. We (directly or through our Third Party Service Providers) perform such automatic collection through use of cookies, web beacons, unique identifiers, and similar technologies which allow us to collect information about the pages and screens you view, the links and objects you click, and other actions you take when using our Platform, Services, or Apps, or within our advertising or email content, as further detailed in section 4.You may be able to control and/or disable this collection of information through the configuration of your device depending on your operating system.     3. Information obtained from third Parties
      We may also collect personal information concerning you, from third parties who have assured us that they have obtained your consent for such provision of information (where applicable) or that you have freely and publicly provided. For example, if you are an End User we will be receiving certain information relating to you from the Subscriber (which is your employer) in order to provide such Subscriber with our Services, e.g., so that we can configure and set up End Users’ profiles on our Platform prior to such End Users first login.We may allow you to share information with social platforms, or use social platforms to create your account or to connect your account with the respective social platforms. Those social platforms may give us automatic access to certain personal information retained by them about you (e.g., content viewed by you, content liked by you, and information about the advertisements you have been shown or have clicked on, etc.). You control the personal information you allow us to have access to through the privacy settings on the applicable social platforms and the permissions you give us when you grant us access to the personal information retained by the respective social platforms about you.By associating an account managed by a social platform with your account on the Platform and authorizing us to have access to this information, you agree that we can collect, use and retain the information provided by such social platform in accordance with this Privacy Policy.
  • What are the Purposes of the Collection and Processing of Personal Information?
    1. Legal Basis for collection and Processing
      We collect, process and use Users information for the purposes described in this Privacy Policy, based at least on one of the following legal grounds:

      1. With respect to Subscriber Admins and End Users
        1. Under our legitimate interest – We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy. This means that we process your information for things like detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality or technical issues with our Services, protecting against harm to the rights, property or safety of our properties, our Users, or the public as required or permitted by law; enforcing legal claims, including investigation of potential violations of this Privacy Policy; in order to comply and/or fulfil our obligations under applicable laws, regulations, guidelines, industry standards and contractual requirements, legal process, subpoena or governmental request, as well as our Terms of Use.Specifically, we process Your personal information on behalf of and for the performance of a contract with our Subscriber, including as necessary for the establishment and performance of our contractual engagements with our Subscriber (who is your employer), in the scope of our role as services providers (processors) to Subscriber and under such Subscriber’s instructions. Under such engagement we shall provide Subscriber with the Services, maintain and improve our Services, Platform and Apps, develop new services and features for our Users and Subscribers, and personalize the Services in order for Users to get a better user experience.
        2. Consent– We ask for your consent to process certain portions of your information for specific purposes, and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with personalized content and ads through the use of cookies.
      2. With respect to Visitors
        1. For the performance of a contract and provision of services – following your acceptance of these Terms, we collect and process your personal information in order to provide you with our Site; to maintain and improve our Services; to develop new services and features for our Users; and to personalize the Services in order for you to get a better user experience.
        2. Under our legitimate interest– We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy. This means that we process your information for things like detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality or technical issues with our Services, protecting against harm to the rights, property or safety of our properties, our Users, or the public as required or permitted by law; enforcing legal claims, including investigation of potential violations of this Privacy Policy; in order to comply and/or fulfil our obligations under applicable laws, regulations, guidelines, industry standards and contractual requirements, legal process, subpoena or governmental request, as well as our Terms of Use.
        3. Consent– We ask for your consent to process certain portions of your information for specific purposes, and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with personalized content and ads through the use of cookies or direct email offers and other marketing material.
    2. Why Do We Use Your Personal Information?

      We may use information that we collect about you, for different purposes, which may vary respectively if you are a Visitor, Subscriber Admin or End User.

      1. To perform the contractual obligations between us and our customer, the Subscriber, which is your employer;
      2. To provide and improve our Services, Platform, Apps and manage our business;
      3. To send you updates, notices, notifications, announcements, and additional information related to the Services;
      4. To be able to manage your account and provide you with customer support;
      5. To conduct surveys regarding our Services or regarding the Users’ experience of our Platform;
      6. To display or send you marketing and advertising material and general and personalized content and advertisement;
      7. To develop, display and track content and advertising tailored to your interests on our Service and Platform, including providing our advertisements to you when you visit other sites;
      8. To create cumulative statistical data and other cumulative information and/or other conclusive information that is non-personal, in which we and/or our business partners might make use of in order to operate and improve our Site, Platform and Apps;
      9. To verify your eligibility and deliver prizes in connection with contests and sweepstakes;
      10. To perform functions or services as otherwise described to you at the time of collection;
      11. To prevent, detect, mitigate, and investigate fraud, security breaches or other potentially prohibited or illegal activities;
      12. To comply with any applicable rule or regulation and/or response or defend against legal proceedings versus us or our affiliates.
  • Sharing Information with Third Parties

    Centrical may share your Personal Information with third parties (or otherwise allow them access to it) in a manner and scope which may vary accordingly if you are a Visitor, Subscriber Admin or End User, and only in the following instances:

    1. Subscriber: We will share certain data concerning Subscriber Admin and End Users with their employer who is our Subscriber as required in the scope of provision of Services to such Subscriber. We never share information of one Subscriber with another, nor Your information with any Subscribers other than your employer.
    2. Third Party Services: We are partnering with a number of selected service providers, whose services and solutions complement, facilitate and enhance our own. These include hosting, database and server co-location services (e.g., AWS), data analytics services (e.g. Google Analytics), customer relationship management platforms (e.g. SalesForce), e-mail and text message distribution and monitoring services (e.g. Exchange 365), payment processors, dispute resolution providers, customer support and call center services (e.g. Zendesk), and our business, legal and financial advisors (collectively, “Third Party Service Providers“).Such Third Party Service Providers may receive or otherwise have access to your Personal Information, depending on each of their particular roles and purposes in facilitating and enhancing the Services, and may only use your Personal Information for such purposes. Such disclosure or access is strictly subject to the undertaking of confidentiality obligations, and the prevention of any independent right to use this information except as required to help us provide the Services. We remain responsible and liable for any personal information processing done by Third Party Service Provider on our behalf, except for events outside of our reasonable control and except for such Third Party Service Providers with whom you have a direct contractual relationship.
    3. Other Users: if you are a Subscriber Admin or End User, our Services allow you to share certain personal information with other End Users on the Platform, by displaying or posting such personal information on the Platform. Therefore, you are required to take into consideration that use of certain functionality or of input fields, available on the Platform, is visible to other End Users and/or Subscriber Admins of the same Subscriber, all as part of the functionality and features of the Services.
    4. Law Enforcement, Legal Proceedings, and as Authorized by Law: We may disclose or otherwise allow access to personal information pursuant to a legal requirement or request, such as a subpoena, search warrant or court order, or in compliance with applicable laws and regulations. Such disclosure or access may occur with or without notice to you, if we have a good faith belief that we are legally required to do so, or that disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing.
    5. Protecting Rights and Safety: We may share your personal information with others, with or without notice to you, if we believe in good faith that this will help protect our rights, property or personal safety, any of our Users, or any members of the general public.
    6. Our Affiliated Companies: We may share personal information internally within our family of companies, for the purposes described in this Privacy Policy. In addition, should we or any of our affiliates undergo any change in control, including by means of merger, acquisition or purchase of substantially all of our assets, your personal information may be shared with the parties involved in such event. If we believe that such change in control might materially affect your personal information then stored with us, we will notify you of this event and the choices you may have via e-mail and/or prominent notice on our Site or Services.

    For the removal of doubt, we may transfer, share or otherwise use non-personal information in our sole discretion and without the need for further approval.

  • Where Do We Transfer or Store User’s Personal Information?

    Information regarding the Users will be maintained, processed and stored by us and our authorized affiliates and service providers in the United States, EU, India and in Israel (as applicable to each Subscriber), and as necessary, in secured cloud storage, provided by our Third Party Service Providers.

    While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, please know that we, our affiliates and our Third Party Service Providers that store or process your personal information on our behalf are each committed to keep it protected and secured, pursuant to this Privacy Policy and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction.

    Specifically, each of our Third Party Service Providers which store or process your Personal Information either: (i) assured us that they provide adequate safeguards to protect your rights to privacy including where applicable, by undertaking to comply with the EU Standard Contractual Clauses; (ii) where applicable, hold and process such information on our behalf in jurisdictions which have been determined to ensure an adequate level protection by the EU Commission; (iii) perform such processing pursuant to your consent and acceptance of their privacy policy as further detailed in this Privacy Policy.

    By providing your information, you expressly consent to the place of storage and transfer described above, including transfers outside of the jurisdiction in which the information was provided.

  • Do You Use Cookies or Similar Tracking Technologies
    1. We use certain monitoring and tracking technologies, including ones offered by third party service providers in order to collect and process certain portions of the personal information we specified above. These technologies are used in order to maintain, provide and improve our Platform and Services on an ongoing basis, in order to provide a better experience to our Users. For example, these technologies enable us to: (i) keep track of and apply our Users’ Services and Site preferences and authenticated sessions, (ii) better secure our Platform by detecting abnormal behaviors, (iii) identify technical issues and improve the overall performance of our Platform and Services, (iv) monitor and analyze our ads’ performance (v) create and monitor analytics relating to use of our Platform and Services, and (v) deliver to you targeted advertisements that are more tailored to you based on your browsing activities and inferred interests.

      • Pixel Tags: Pixel tags (also commonly known as web beacons) are transparent images, iFrames, or JavaScript placed on our Website or our advertisements and emails, that our third party service providers use to understand how the Website, such advertisements and emails are interacted with.To learn more about our use of Cookies and other tracking technology that we use please see our Cookie Policy.
    2. Some of these tracking technologies are provided to us by our Third Party Services Providers who collect and process personal information on our behalf. These Third Party Services Providers may have direct contractual relationship with you (such as Google and Facebook). Additionally, the services provided to us by such Third Party Services Providers may entail collection and processing of personal information by such Third Party Services Providers, in a scope which is broader than the scope of personal information we are eventually provided with by such Third Party Services Providers. This means that sometimes these Third Party Services Providers have more access to your personal information than we do. For example, Google Analytics has broad access to your information, while we only receive access to aggregate statistical information, in order to better protect your rights. To the extent you have direct contractual relationship with any of our Third Party Services Providers, any rights you may have with respect to your information, collected by such Third Party Services Providers, shall be governed by such contractual relationship. Otherwise the terms of this Privacy Policy shall fully apply.
    3. In this context you should note that we use Google Analytics, Facebook, Twitter and LinkedIn’s functionality of re-marketing through their tracking cookies and pixel-based retargeting services. This means that if you provided your consent to Google, Facebook, Twitter or LinkedIn (the “Social Ad Platforms”) to be provided with personalized commercial offers, you may be served with ads (including advertisements of third parties) based on your access to the Services or Site, outside of the Services and Website and across the internet. In such event the Social Ad Platforms, will place cookies on your web browser and use such cookies to serve you ads based on past visits to our Services and Site.

Please note however that deleting any of our tracking technologies or disabling future tracking technologies may prevent you from accessing certain areas or features of our Site, or may otherwise adversely affect your user experience.   • Direct Marketing

    You hereby agree that we may use Visitors contact details provided during the filling of a contact form on our Site, for the purpose of informing you regarding our products and services which may interest you, and to send to you other marketing material. You may withdraw your consent via sending us written notice by email to the following address: privacy@centrical.com  or by pressing the “Unsubscribe” button in the mail.

    Please note that we may also contact Users with important information regarding our Platform, Services or Site. For example, we may notify you (through any of the means available to us) of changes or updates to our Platform, Services or Site, payment issues, service maintenance, etc. You will not be able to opt-out of receipt of such service messages.

  • Minors
    1. To use the Services or Platform, you must be over the age of sixteen (16). Centrical does not knowingly collect personal information from children under the age of sixteen (16) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of sixteen (16) are not using the Services or Platform. In the event that it comes to our knowledge that a person under the age of sixteen (16) is using the Services or Platform, we will prohibit and block such User from accessing the Services or Platform and will make all efforts to promptly delete any personal information stored with us with regard to such User.
    2. Any California residents under the age of eighteen (18) who have registered to use the Platform or Services, and who have posted content or information to the Platform, can request that such information be removed from the Platform by contacting us using the contact form or by sending a letter to privacy@centrical.com, stating that they personally posted such content or information and detailing where the content or information is posted. We will make reasonable good faith efforts to remove information or anonymize it so the minor cannot be individually identified. This removal process cannot ensure complete or comprehensive removal.
  • How Do You Keep My Information Secure?

    We take a great care in implementing and maintaining the security of the Services and Platform, and the User’s personal information. We have implemented administrative, technical and physical safeguards to help prevent unauthorized access, use or disclosure of your Personal Information. Your information is stored on secure servers and isn’t publicly available. We limit access of your information only to those employees, third party service providers or partners on a “need to know” basis, and strictly in order to enable us to perform the agreement between you and us.

    Please note however, that regardless of the measures we take and the efforts we make, we cannot and do not guarantee the absolute protection and security of any personal information.

  • Data Retention

    We may retain your personal information for as long as legitimately and to the extent required, for the achievement of the purposes set forth above. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. If you withdraw your consent to our processing of your Personal Information, we will delete your Personal Information from our systems (except to the extent retaining such data in whole or in part is necessary to comply with any applicable rule or regulation and/or to respond to or defend against legal proceedings brought against us or our affiliates).

  • Your Rights
    1. Visitors
      1. If applicable to you under your country’s jurisdiction, you may have certain rights in connection with your Personal Information and how we handle it.         • Right of access. You may have a right to know what information we hold about you and, in some cases, to have the information communicated to you. We reserve the right to ask for reasonable evidence to verify your identity before we provide you with any information.
        • Right to correct Personal Information. We endeavor to keep the information that we hold about you accurate and up to date. Should you realize that any of the information that we hold about you is incorrect, please let us know and we will use our best efforts to correct it as soon as we can.
        • Data deletion. In some circumstances and under certain laws and regulations, you may have a right to request that some portions of the Personal Information that we hold about you be deleted or otherwise anonymized/de-identified.
        • Data portability.       2. End Users and Subscriber Admins
        As stated above, if you are an End User or Subscriber Admin, Centrical is collecting and processing Your personal information as merely a processor (as defined under applicable EU legislation). We are doing so in the scope of services provided by Centrical to a Subscriber which is your employer or another enterprise who engages you as an employee or service provider, and in accordance with such Subscriber’ instructions.Therefore, End Users and Subscriber Admins may only contact Subscriber with any request to exert their rights, claim or question, with respect to their personal information, collected and processed hereunder.  Centrical will act according to the instructions of the applicable Subscriber on such matters.
  • How Do We Use The Information of Job Candidates

    We welcome qualified candidates to apply to any of the open positions posted on our Site by sending us your contact details and CV or resume (“Candidate Information”). Since privacy and discreetness are very important to our candidates, we are committed to keep Candidate Information private and will use it solely for our internal recruitment purposes (including for identifying candidates, evaluating their applications, making hiring and employment decisions, and contacting candidates by phone or in writing).

    Please note that we may retain Candidate Information submitted to us even after the applied position has been filled or closed. This is done so we could re-consider candidates for other suitable positions and opportunities at Centrical; so we can use the Candidate Information as a reference for future applications; and in case the candidate is hired, for additional employment and business purposes related to their employment with us.
